101 Things to do in The Mackay Region competition terms and conditions
1. Introduction
1.1 These Terms and Conditions (General Contest Rules) shall be binding on you when entering the ‘101 Things to Do in The Mackay Region 2019 competition’ operated by MACKAY TOURISM LTD.
1.2 No purchase or payment is necessary to enter the ‘101 Things to Do in The Mackay Region 2019 competition’ and copies of Contest Rules are available on the MACKAY TOURISM LTD website.
1.3 Entry and participation in the ‘101 Things to Do in The Mackay Region 2019 competition’ shall be deemed an unconditional acceptance by you of these Terms. All entry instructions and any other specific details relating to the competition or the prizes form part of these Terms.
2. Eligibility
2.1 Employees of MACKAY TOURISM LTD, their immediate families, media, agencies, sponsors and commercial partners or any other persons directly or indirectly connected with the competition are not eligible to enter the competition.
2.2 Multiple entries are permitted.
2.3 There is no age restriction for entrants, however, entrants under 18 years old must have a parent’s or legal guardian’s permission to enter.
2.4 All decisions of MACKAY TOURISM LTD will be final and binding. No correspondence will be entered into.
2.5 All entries (including postal) must be received by 5 pm Sunday, 14 July 2019. No late submissions will be accepted.
3. Prizes
3.1 If the winner is unable to attend the prize presentation, all prizes must be collected within one month from the date of winning from the Mackay Visitor Information Centre, 320 Nebo Road, Mackay QLD 4740. After that time, unclaimed prizes will be deemed null and void.
3.2 MACKAY TOURISM LTD will not notify winners of the time remaining. It is the sole responsibility of winners to collect their prize.
3.3 Identification that includes a photograph (driver's license, passport, student card) will be required when collecting the prize.
3.4 Where the winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with at the absolute discretion of MACKAY TOURISM LTD.
3.5 All prizes are accepted entirely at the risk of the winner and MACKAY TOURISM LTD excludes all warranties in connection with any prize.
3.6 Prizes are not transferable, must (where applicable) be used on the dates specified and may not be redeemed for cash or other goods and/or services.
3.7 Each prize includes its’ own terms and conditions. Please see below for the terms and conditions of each prize.
3.8 Winners will be contacted via the phone number supplied on Wednesday, 17 July 2019. Should a winner not be contactable by phone, an email will be sent that day to the address supplied and a follow-up call made Thursday, 18 July 2019. If a winner is not contactable on the means provided by 5 pm Thursday, 18 July 2019, their prize will be deemed null and void.
3.9 Any expenditure by the winner above the maximum value of the prize claimed is not the responsibility of MACKAY TOURISM LTD.
3.10 MACKAY TOURISM LTD, its agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or claims, liability, loss or damage arising out of or in connection with any contest promoted by MACKAY TOURISM LTD.
3.11 Where prizes are to be provided by a third party, then the winner(s) will be required to complete all appropriate or applicable booking or other formalities direct with such provider. MACKAY TOURISM LTD will have no responsibility for the acts or defaults of any other persons.
3.12 MACKAY TOURISM LTD reserves the absolute right to disqualify any entrant to any competition which it considers has used improper means to enter.
3.13 All winners of all prizes must agree to these General Terms and Conditions in order to claim their prize.
4. The Competition
4.1 Fraudulent, illegible, illicit, offensive or incorrect entries will not be accepted (at the absolute discretion of MACKAY TOURISM LTD).
4.2 The selection of a winner by MACKAY TOURISM LTD is final and binding, and no correspondence will be entered into.
4.3 MACKAY TOURISM LTD may terminate any contest at any time at its absolute discretion. In the event of such termination, MACKAY TOURISM LTD may, at its absolute discretion, elect not to award any prize in respect of the terminated contest.
4.4 Entry into the competition is limited to digital entries via MACKAY TOURISM LTD’s website at www.mackayregion.com/101things.
4.5 Complete contact details must include the entrant’s first and last name, email address, phone number and suburb.
5. Confidentiality
5.1 The information will only be accessed by employees and authorized representatives of MACKAY TOURISM LTD.
6. Publicity
6.1 The winning entrant may be required by MACKAY TOURISM LTD to participate in a photo and/or video, and acknowledge that MACKAY TOURISM LTD has the right to use such publicity photos and/or videos in any medium and in any reasonable manner it sees fit, unless that person informs MACKAY TOURISM LTD at the time of entering the competition that he or she wishes to retain his or her anonymity.
6.2 Contest entries and material submitted in connection with any contest (whether in written, audio, electronic or visual form, or any combination of those) or any photographs, video and/or film footage and/or audio recording taken of competitors remain the property of that entrant, with MACKAY TOURISM LTD given full permission as a condition of entry to have unlimited usage in any MACKAY TOURISM LTD sees fit.
6.3 MACKAY TOURISM LTD may incorporate information from entrants and voters in any contest in any database to be used for the purpose of its business. Upon entry into a competition or submission of a vote, an entrant/voter will automatically give permission for use of personal data and this information will be retained in accordance with the Privacy Information Act.
7 Jurisdiction
7.1 These rules shall be governed and construed in accordance with Queensland Law.
7.2 MACKAY TOURISM LTD may change these General Contest Rules at any time at their discretion.
